So I didn't know this being gone for years but now apparently Enemy AI (Charr Chaot) does not use this skill on their own party members, only on non-party-member allies.
Weird...

Yeah that is weird. I looked it up after I first read your post and it seems like it has always been like that. Some weird little bug that never got changed. This little excerpt, below, from GW wiki hints that there may be other spells like it.
GW Wiki: Allies who are not party members will not be affected by spells or skills that specify "party members" instead of "allies". For some skills this isn't true, but such cases are believed to be bugs in the skills' wording.
Pretty cool. Just curious Justice, how did you realize this?

Someone told me charr chaots didn't have shatter hex but I knew they did. So I went to test it outside grendich courthouse and they weren't casting it. Went to the northland's on my mesmer and they still weren't casting it. Decided to start using life siphon on my war/nec in pre for a few charr runs and when I was fighting a charr boss one of the patrols showed up and a chaot cast shatter hex on him. Reading the note on wiki on shatter hex page and also talk page I realized their was more going on. I went back outside grendich courthouse and found a group with a chaot. Killed his 3 allies then lured him to a second group and casted hexes on them. The chaot was using shatter hex on recharge.
